Action by iamkart:
Initial Action: A warning is issued, and the user’s account may be temporarily suspended.

For example, if a user repeatedly posts offensive or hateful comments on the iamkart community forums despite multiple warnings, iamkart may take the above actions.

PRICING INFORMATION

We at iamkart strives to provide accurate product and pricing information, still pricing or typographical/ clerical errors may occur. iamkart cannot confirm the price of a product until you place an order. Price may vary at the time of purchase. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, iamkart shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been despatched. In the event that an item is mis-priced, iamkart may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been despatched, your offer will not be deemed accepted and iamkart will have the right to modify the price of the product and contact you for further instructions using the e-mail address/ phone number provided by you during the time of registration, or cancel the order and notify you of such cancellation. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your bank account.

We strive to provide you with the lowest prices possible on iamkart. However, sometimes a price online does not match the price in a store. In our effort to be the lowest price provider in your particular geographic region, store pricing will sometimes differ from online prices. Prices and availability are subject to change without notice.

OUT OF STOCK

If product is not in stock, iamkart have every right to cancel the order without intimation to customer, and email will be sent for cancelled order. In the event of Out of Stock, full amount will be refunded back to customer.

A 2.5% cancellation charge will apply to the total order value if the cancellation occurs within this timeframe, provided the order has not yet been processed for shipment. Orders canceled after 30 minutes of placing the order will incur a 5% cancellation charge, provided the order has not been processed for shipment. iamkart has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by iamkart and accepts iamkart‘s decision regarding the cancellation. Products once dispatched cannot be returned/Cancelled under any circumstances. Nothing herein will prevent you from returning the product pursuant to rights available to you under applicable law. Cash on delivery orders (COD) once processed/approved, can no longer be cancelled. Orders are considered processed/approved after 30 minutes of placing the order.

CANCELLATION BY iamkart
Reasons for Cancellation L iamkart reserves the right to cancel an order under the following circumstances:
The item is out of stock.
There are pricing or typographical errors.
Fraudulent or unauthorized transactions.
Any other reason deemed necessary by iamkart management.

NOTIFICATION OF CANCELLATION
If LX INDIA cancels an order, the customer will be notified via email or phone, and a refund will be issued.
(1)Refunds: Refunds for canceled orders will be processed within 3-4 business days. However, the actual processing time may vary depending on the customer’s payment provider or bank.
(2)Non-Cancelable Items Certain products cannot be canceled or refunded, including but not limited to:
Personalized or custom-made items.
Perishable goods.
Items that are marked as final sale or non-returnable.

RETURN & REFUND’S TERMS &CONDITIONS

(1)Return Eligibility
Returns are accepted only for damaged, defective, or incorrect products delivered to the customer.
Items must be returned within 7-10 days from the date of delivery.
Products must be in their original, unused condition, with all packaging, tags, and labels intact.
(2)Non-returnable Items
The following items are non-returnable:

SALE TERMS

Goods once sold will not be taken back or exchanged. Once invoice is generated, it cannot be modified or cancelled for any reasons thereof.

The item is tested for physical damage at the point of sale and the company is not liable for the physical damage of item thereafter. It is also the duty of the buyer to immediately check at the counter physical condition of the purchased goods. All goods are consigned at buyer’s risk and the company is not responsible for any loss, damage or pilferage in transit.

Our responsibility ceases the moment goods leaves our warehouse.

If no identity verification is done by the account holder of the registered email, or if found fraudulent, iamkart has the rights to cancel the corresponding orders and ban the linked accounts.

Customer can go to nearby authorised service centre of the particular vendor for getting the product replaced/repaired. We are always there to help customer by taking product back and arranging for its replacement.

CREDIT CARD DETAILS

You agree, understand and confirm that the credit card details provided by you for availing of services on iamkart will be correct and accurate and you shall not use the credit card which is not lawfully owned by you. i.e., in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to iamkart. Further the said information will not be utilised and shared by iamkart with any of the third parties unless required by law, regulation or court order. iamkart will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively on you.

Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by iamkart and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Ernakulam. The High Court of judicature at Ernakulam alone shall have the jurisdiction and the Laws of India shall apply.

REVIEWS, FEEDBACK, SUBMISSIONS

The refund time may vary depending on the payment method and gateway used. iamkart cannot guarantee timely refund of the amount that is debited during purchase. We will try our level best to address issues regarding refunds.

*Company will not refund any amount paid as transaction charges paid during initial payment to the payment gateway as processing charges & also processing charges incurred for refund.

WARRENTY POLICY

We are authorized distributors only. The warranty for all products is provided directly by the respective manufacturer.

(2)Warranty Claims

In sum, in no event shall Company’s total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.
